Terms of Service


By using this website ("Service") you are agreeing to be bound by the following terms and conditions ("Terms of Service") with Graduate School of Motoring - ABN 64 627 997 648.

Graduate School of Motoring reserves the right to update and change the Terms of Service without notice.


Heavy Vehicle Package Terms

Payments

Full payment for Package Deals or a $200.00 Non-Refundable Deposit is required to secure your booking (lesson, test or both) prior to the first session, payments can be made via credit card or EFT. If you have not paid your Deposit by the due date, then your lesson / test will be rescheduled.

All deals / packages do not include any TMR fees. The Heavy Vehicle Theory Test cost ($26.20) and the Practical Driving Test Booking Fee is ($61.25) - GSOM can pay the Practical Driving Test Booking Fee on your behalf for $70.00 (admin charge included).

Student Responsibilities

It is the sole responsibility of the student to ensure that if you require a medical certificate or glasses for driving that you bring these with you and that they are current. The medical certificate must state the class of licence (MR, HR, HC, MC) that you are applying for. A condition of your licence states that these must be carried with you at all times when driving. If you do not have these, you will forfeit your lessons/test and any monies paid.

It is the sole responsibility of the student to ensure that you are eligible to undertake training and that your licence is not cancelled or suspended -If you are not eligible for whatever reason you will forfeit your lessons/test and any monies paid. You must be fit for driving and/or lessons.

Packages

Extra lesson/s may be required at a cost in addition to the Deals offered.

Trainer / Truck may change from time to time if circumstances require it.

Insurance

There is an insurance excess of $2500 for the vehicle that you will be driving, in the event of an accident you will be liable to pay the excess - whether at fault or not. In the event of an accident should GSOM deem it not in its best interest to lodge an insurance claim, you will be liable to pay for any damage to the value of $2500. GSOM has an option for you to pay a once only fee of $50 that covers you for the life of your training and the excess of $2500 will be waived.

This insurance option is optional and completely up to each individual student.

TMR Practical Driving Tests

You (the student) give permission for GSOM to use your CRN to secure a Practical Driving Test with TMR.

You (the student) agree that any Practical Driving Test bookings made by GSOM on your behalf in your name using your CRN may be swapped, changed or cancelled without your knowledge - this is to enable us to provide you with a driving test at the earliest possible date.

There is no guarantee of a successful assessment result.

Multi Combination

You are not paying for a licence!

You must be deemed competent by your trainer / assessor to receive the statement of attainment for the MC TLI4006 - if you do not meet the standard required you will not be competent and will be required to book and pay for additional lessons at the current rate of $440 per 2 hours if you wish to continue with your training and assessment.

There is a minimum charge of $880 for four (4) hours reassessment

A $500 deposit is payable at the time of booking this includes a non refundable $200 administration fee.

If you have an open class licence with no conditions (road ranger) you will need to demonstrate competency in a road ranger prior to completing your MC licence. (This does not apply to students who have an Auto or B condition on their licence who choose to be assessed in an automatic)

TMR Inspections

Should you be delayed by TMR for a roadside inspection, the Police or for any other reason, hours lost will be forfeited as this is out of GSOM Training's control and a part of daily situations that may occur when driving a heavy vehicle. We apologise in advance for any inconvenience.

Graduate School of Motoring Rights

As a driver education business, we have the right to:

  • Program to run and/or cancel any course, ensuring all students are notified and supported
  • Adjust course fees, times or dates for the whole or any part of a program as required

Student Responsibilities

All students must ensure that they:

  • Treat all staff, students and the public with respect, fairness and courtesy
  • Treat others equitably irrespective of gender, sexual orientation, race, disability, medical condition, cultural background, religion, marital status, age, or political conviction
  • Provide true and accurate information throughout the course of their enrolment and provide updated details as required
  • Provide a valid USI on enrolment of Drive Multi Combination Vehicle Course
  • Pay the necessary fees by the due date
  • Meet their Workplace Health and Safety (WHS) duty of care responsibilities and follow any WHS instructions
  • Are not under the influence of alcohol or illegal drugs in the learning environment
  • Follow all Covid-19 safety measures as directed by GSOM and in line with Government Health advice.

Student Rights 

All students will: 

  • Be treated fairly and with respect by trainers, other staff and other students irrespective of gender, sexual orientation, race, disability, medical condition, cultural background, religion, marital status, age, or political conviction
  • Learn in a safe training environment free from harassment and discrimination
  • Receive the training and support necessary to achieve educational goals (once all fees are paid or exemptions granted)
  • Have their personal information stored, maintained and protected in accordance with the National Privacy Principles
  • Have access to our consumer protection system and our complaints and appeals process
  • Are made aware of the fees and charges relevant to completing their training
  • Receive accurate Statements of Attainment on successful completion of an accredited training course

Smoking, Drugs and Alcohol

People under the influence of alcohol or unauthorised drugs in in our learning environment are a danger to themselves and to others. Smoking can also present an immediate danger, in relation to flammable or explosive substances, as well as long-term health damage.

Graduate School of Motoring is a smoke-free workplace. Smoking is prohibited in all buildings and only permissible at designated locations. Any student under the influence of drugs and/or alcohol is not permitted on our premises, to use our facilities or equipment, or to engage in any Graduate School of Motoring activity. People taking prescription medication have a duty to ensure their own safety, and that of others, is not affected.

Upgrading a licence

If you have a Queensland provisional or open licence, you can learn to drive the next highest vehicle class.

If your provisional or open licence only authorises you to drive a class of motor vehicle fitted with an automatic transmission, you are also authorised to learn to drive or ride the same or higher class of motor vehicle fitted with a manual transmission.

Learning to drive a higher class

When learning to ride or drive in a higher licence class, you must: 

  • be accompanied by a supervisor who holds an open licence in the licence class you are learning to drive in and has held that licence class for at least 1 year
  • clearly display L plates at the front and rear of the vehicle (back only for motorcycles)
  • show your provisional or open licence to a police officer if required
  • obey a zero-alcohol limit and not be under the influence of illegal or prescription drugs
  • obey any conditions stated on your licence.

Unaccompanied learner drivers will get 4 demerit points and a $213 fine.

The maximum court-imposed penalty for this offence is more than $2,600.

Fees and Charges

Unless stipulated, all our fees are inclusive of administration charges and training delivery.  All student fees are payable on or before training commencement.

Our Refund Policy  

  • $50 of your fees is an administration, non-refundable fee
  • Once training has commenced in the package, no refund is available to participants who leave before finishing the package unless the Participant can provide a medical certificate or show extreme personal hardship.
  • Should GSOM cancel the package, participants are entitled to a full refund (or prorated adjusted refund) or to transfer to another package. In this event Participants will be given their preferred option.
  • If you cancel more than 72 business hours (3 days) prior to commencement you will receive a refund of all fees except the $50 administration fee.
  • If you cancel a package with less than 72 business hours (3 days) notice your non-refundable $200.00 deposit will be charged.
  • If you cancel a package with less than 48 business hours (2 days) notice the full fee will be charged. If you cancel for medical reasons and provide a medical certificate the cancellation fee will be reduced to 50%.
  • GSOM requires 48 business hours notice to cancel a test otherwise the full fee will be charged.
  • Any refunds will incur a $50 administration charge - no exceptions.
  • All training must be completed within 12 months of paying your package or you will forfeit any fees you may have paid - no exceptions, no refunds, no balance of lessons etc
  • If you cancel an MC course there is a non-refundable $200 administration fee.

Cancellations by GSOM

Should GSOM cancel training before it commences, you will be offered alternate dates (if the training is being rescheduled).  If the training is not rescheduled or the dates offered do not suit you, all fees paid will be refunded in full within 10 days of the training being cancelled.

General Services Terms 



Account Terms

This page contains the most current version of the Terms of Service.

  • Accounts registered by "bots" or other automated methods are not permitted and will be removed.
  • You are responsible for all activity that occurs from your account.
  • You agree that Graduate School of Motoring can send you booking reminders, relevant information and other marketing via phone, SMS and/or email. You can opt out of any marketing.
  • You must not post or submit false information to the Service.
  • You are responsible for maintaining the security of your account and password. Graduate School of Motoring cannot and will not be liable for any loss or damage from your failure to comply with this security obligation.
  • You must not use the Service for any illegal or unauthorised purpose. You must not use this Service to violate any laws in your jurisdiction, including but not limited to copyright laws.
  • Graduate School of Motoring has the right to suspend or terminate your account, refuse any current or future use of the Service, or any other Graduate School of Motoring service, for any reason.
  • Violation of any of the terms or general conditions may result in the termination of your Account.
  • In the event that you breach these Terms of Service, or act in a way that puts the Service or any individual at risk, Graduate School of Motoring has the right to suspend or terminate your account and refuse any and all current or future use of the Service, or any other Graduate School of Motoring service. Such termination of the Service will result in the deactivation of your Account.

Cancellation Rates

Cancellation, non-attendance or the rescheduling of a booking will incur the following charges:
  • Less than 12 hours notice before the booking will forfeit the full booking fee.
  • Less than 24 hours notice before the booking will forfeit 50% of the booking fee.
  • Less than 48 hours notice before the booking will forfeit 20% of the booking fee.
A cancellation does not automatically refund payment of products or services. Any amount not subject to the cancellation fee, is credited towards your account balance at Graduate School of Motoring.

 

Refund Policy

Vouchers and Packages 

We are not required to provide a refund if you change your mind about the service you asked for.

You can choose to cancel your service and receive a refund for unconsumed services, if the service has a major problem. This is when the service:

  • has a problem that would have stopped someone from buying the service if they had known about it 
  • is substantially unfit for it's common purpose, and can't be easily fixed within reasonable time
  • does not meet the specific purpose you asked for and cannot be easily rectified within a reasonable time
  • creates an unsafe situation.

If you choose to continue with the service, you can ask us to compensate you for any difference in the value of the services we provided and what you paid.

If the problem is not major, we will fix it within a reasonable time. If it is not fixed within this time, you can choose to have someone else fix the problem and recover all reasonable costs from us. If the problem cannot be fixed we view it as a mojor problem. Please keep proof of your agreement - e.g. you invoice or quote.

Modifications to Services and Prices

  • Graduate School of Motoring reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice.
  • Prices of all Services are subject to change with or without notice.
  • Graduate School of Motoring shall not be liable to you or to any third party for any modification, price change, suspension or discontinuance of the Service.

Vouchers

  • Vouchers are non-refundable and cannot be redeemed for cash.
  • Unused vouchers cannot be transferred between clients.
  • Purchases containing multiple vouchers can only be used by a single person and cannot be split between people.
  • Vouchers are valid for 12 months from the date of purchase.

Fees

  • Credit card security is implemented using secure SSL encryption on all transactions and processed using a secure, trusted, PCI compliant payment gateway and used by Graduate School of Motoring for payment processing.
  • All fees and transactions are in Australian Dollars.

General Conditions

  • Your use of this website is at your sole risk. The website is provided on an "as is" and "as available" basis.
  • You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the website, use of the website, or access to the website without the express written permission by Graduate School of Motoring.
  • Verbal, physical, written or other abuse (including threats of abuse or retribution) of any Graduate School of Motoring customer, employee, member, trainer, officer or external contractor will result in immediate account termination.
  • You must not transmit any worms or viruses or any code of a destructive nature.
  • You understand that Graduate School of Motoring uses third party vendors and hosting partners to provide the necessary hardware, software, networking, storage, and related technology required to run.
  • Graduate School of Motoring does not warrant that (i) the website will meet your specific requirements, (ii) the website will be uninterrupted, timely, secure, or error-free, (iii) the results that may be obtained from the use of the website will be accurate or reliable, (iv) the quality of any products, websites, information, or other material purchased or obtained by you through the website will meet your expectations, and (v) any errors in the website will be corrected.
  • You expressly understand and agree that Graduate School of Motoring shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if Graduate School of Motoring has been advised of the possibility of such damages), resulting from: (i) the use or the inability to use the website; (ii) the cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through or from the website; (iii) unauthorised access to or alteration of your transmissions or data; (iv) statements or conduct of any third party on the website; (v) or any other matter relating to the website.
  • The failure of Graduate School of Motoring to exercise or enforce any right or provision of the Terms of website shall not constitute a waiver of such right or provision.
  • You expressly understand and agree that Graduate School of Motoring shall not be liable for any indirect, incidental, special, consequential loss, loss or corruption of data or exemplary damages, including but not limited to loss resulting from the use or the inability to use the website or the Service.
